Dr. Farghal Ali was born in 1960.

He obtained his PhD Summa Cum Laude in Da’wa (proselytization) and Islamic Culture from the school of theology of Al-Azhar University in 2000.

Prior to that, he received Al-Azhar University's teaching diploma in 1980, followed by a bachelor's degree Cum Laude from the school of Da’wa of the same university, in Cairo in 1986. He later obtained a master's degree Magna Cum Laude in Da’wa (proselytization) and Islamic Culture from the school of Theology of Al-Azhar University in 1996.

Dr Ali taught Arabic language sciences at Al-Azhar before he was sent to Yemen in 1986. He returned to Egypt in 1990, where he worked as a preacher, senior preacher, and then as an inspector. Shortly afterwards, he moved to America where he has worked as an imam at several Islamic centers, including Al-Aman in Holmdel, Al-Tawheed in Jersey City, Al-Tanweer in Plainfield, and Bayt al-Maqdis in Brooklyn. He is currently the Imam of the Islamic center of Jersey City.

As to what follows, sale in language is defined by scholars as “swap,” which is swapping money for money lawfully. In Islamic law, it is defined as the transfer of ownership in exchange for compensation in a permissible manner; that is to say that the seller owns the good which ownership is being transferred to the buyer in exchange for money, property, or something else in a permissible way, based on request, reply, and approval. As for the case related to the question, sale is invalid in terms of language and Islamic law because the seller does not own the transported goods, he did not hand it over or received its amount; therefore the sale lacks all its conditions and is invalid. Allah is the Highest and the All-Knowing, and peace and blessings be upon our Prophet, His family and His companions.

الحمد لله والصلاة والسلام على سيدنا رسول الله وعلى اله وصحبه ومن والاه وبعد ، فقد عرف العلماء البيع بانه فى اللغة المبادلة يعنى مبادلة مال بمال على وجه حلال ، وشرعا بأنه نقل الملك بعوض بوجه جائز ، يعنى ان البائع يملك السلعة التى ينقل ملكيتها الى المشترى مقابل عِوَض من مال أو شئ كعقار ونحوه ، بوجه جائز يعنى على صيغة الطلب والاجابة والرضا ، اما فى هذه الحالة موضوع السؤال فالبيع فاسد لغة وشرعا لان البائع لا يملك السلعة المنقولة ولَم يسلمها ولَم يستلم ثمنها ، فالبيع فاقد لشروطه كلها فهو فاسد ولا يجوز والله تعالى اعلى واعلم وصلى الله على سيدنا محمد وعلى اله وصحبه وسلم

I and my husband got divorced, and the judge issued a verdict that I (the wife) should pay my ex a monthly alimony. Is this permissible in Islam? هل بإمكان الرجل أن يحصل على النفقة؟ تطلقت أنا وزوجي وقد أصدر القاضي حكما يقضي بأنه علي (أنا الزوجة) أن أقوم بصرف نفقة شهرية لطليقي. هل هذا جائز في الإسلام؟

The wife does not bear any expenses in Islam. All the expenses are borne by men: before marriage, during marriage, and afterwards. Allah says: “Men are in charge of women by what Allah has given one over the other and what they spend from their wealth.” Allah also says: “But give them compensation -the wealthy according to his capability and the poor according to his capability- a provision according to what is acceptable, a duty upon the doers of good.”
